1. Who We Are

USA Social Marketing (“USA Social Marketing,” “we,” “us,” “our”) provides done-for-you social media content creation, scheduling, and blog/SEO services for small businesses, based in Boston, MA. These Terms of Service (“Terms”) govern your use of our website (usasocialmarketing.us) and any services you purchase from us (the “Services”).

By subscribing to a package, submitting our contact or onboarding forms, or otherwise using our Services, you agree to these Terms.

2. Our Services

We offer three subscription packages, described in full (and priced) on our Packages & Pricing page:

  • Starter ($297/mo): 12 posts/month for one platform, 30-day content calendar, monthly review.
  • Growth ($597/mo): Everything in Starter, adapted for three platforms, 12 branded graphics, one SEO blog post/month.
  • Pro ($997/mo): Everything in Growth, plus scheduling/publishing of approved posts, monthly performance report, priority support.

Content is prepared using AI-assisted tools and reviewed by a person before it is delivered to you. You approve every batch of content before anything is scheduled or published — we do not publish anything to your accounts without your sign-off.

3. Onboarding

After subscribing, you’ll complete a short welcome questionnaire. The accuracy and completeness of the information you give us (business details, brand voice, target customers, etc.) directly affects the quality of the content we prepare. We are not responsible for content that reflects information you provided incompletely or inaccurately.

4. Fees, Billing, and Cancellation

  • Subscriptions are billed monthly in advance through Stripe, our third-party payment processor. We do not store your card details.
  • No contracts — cancel anytime. Cancelling stops future billing; it does not refund the current billing period.
  • Because content work begins immediately after your questionnaire is submitted, payments are non-refundable once a billing period has started. If you cancel before any content has been delivered for that period, contact us at Contact@usasocialmarketing.us and we’ll consider a case-by-case refund.

5. Content Review, Approval, and Publishing

  • For all packages, you (or your designated reviewer) approve each content batch before it is considered final.
  • For Pro subscribers, once you approve a batch, we schedule and publish it to the social accounts you’ve connected. You can revoke our access to those accounts at any time (see Section 6).
  • We use AI tools to draft content, with human review before delivery. AI-assisted does not mean unsupervised — but you’re the final check. Once you approve a batch, you’re confirming it’s accurate and suitable to post under your business’s name.

6. Social Media Account Access

Pro-tier scheduling/publishing requires connecting your social media accounts through our scheduling platform (currently SocialPilot) via that platform’s own authorization (OAuth) — we never ask for or store your social media passwords. You may revoke this access at any time through your social platform’s own security/apps settings, or by asking us to disconnect the account on our end. Revoking access will stop us from publishing to that account but does not cancel your subscription.

7. Intellectual Property

Content we create specifically for you (captions, graphics, blog posts) becomes yours to use once it’s been paid for as part of your active subscription. We may showcase completed work in our own portfolio or marketing materials unless you ask us in writing not to.

8. No Guarantee of Results

We do not guarantee specific outcomes — follower growth, engagement, search rankings, leads, or sales. Marketing results depend on many factors outside our control (your market, platform algorithm changes, your responsiveness in the approval process, etc.). Our monthly performance reports (Pro tier) reflect actual activity but are not a promise of future results.

9. Third-Party Platforms

Your use of Facebook, Instagram, LinkedIn, X, Pinterest, Google Business Profile, and any other connected platform remains subject to that platform’s own terms of service. We’re not responsible for actions those platforms take on your account (suspensions, algorithm changes, policy enforcement, etc.), though we’ll do our best to help you navigate any issues that affect your content.

10. Limitation of Liability

To the maximum extent permitted by law, USA Social Marketing’s total liability for any claim arising from the Services is limited to the amount you paid us in the three (3) months preceding the claim. We are not liable for indirect, incidental, or consequential damages (lost profits, lost business, etc.).

11. Termination

We may suspend or terminate your access to the Services if you violate these Terms, fail to pay, or ask us to post content that is illegal, infringing, or that we reasonably believe could harm our business or reputation. You may cancel your subscription at any time per Section 4.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect means you accept the updated Terms. Material changes will be noted with an updated “Last updated” date.

13. Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict-of-law principles.
